Consumer Law is central to the practice of Chambers and focuses on all aspects of the regulation of business and public bodies in their dealings with consumers. It covers a wide range of consumer contracts and trading practices. Members are instructed not only in civil disputes between consumers and businesses, but by both businesses and regulators in enforcement actions (both civil and criminal) and by both trade associations and consumer protection bodies such as the Consumer Association Which?.
Examples of legislation covered by this practice area the Consumer Protection from Unfair Trading Regulations 2008, the legislation on unfair terms (now in the Consumer Rights Act 2015) and on distance contracts and contracts made away from business premises (now in the Consumer Contract s (Information, Cancellation and Additional Charges) Regulations 2014). Our expertise in financial services regulation under the Financial Services and Markets Act 2000 has led to instruction in relation to financial mis-selling and contraventions of FCA rules.
Topics with which members have been involved include the regulation of gym club contracts, package holidays, timeshare agreements, airline ticket pricing, hedging, PPI and other financial products, estate agents contracts, payment card surcharges, “perpetual sales” and sheltered accommodation contracts. We also have particular expertise in food law (including labelling and food hygiene and contamination cases), and on pharmaceutical, medicines and medical device issues.
With so much consumer protection legislation derived from European directives and regulations, Henderson Chambers is particularly well placed to provide advice on such legislation with its strong European Law expertise.
