In recent years, Lia’s practice has focused on consumer law primarily in the context of mass claims and group actions.

She is currently instructed in several sets of mass claims involving consumer credit and consumer contract law. Many of these claims involve allegations of (i) defective products (ranging from sofas to medical devices), (ii) the mis-selling of products (ranging from credit and insurance products to solar panels and timeshares), (iii) connected lender liability (i.e. under sections 56 and 75 of the Consumer Credit Act 1974), (iv) unfairness under section 140A of the 1974 Act, and/or (v) prohibited practices under the Consumer Protection from Unfair Trading Regulations 2008.

She is also currently instructed by the Defendants in the Mercedes Benz NOx Emissions Litigation.

Employment law is another area of Lia’s practice. She represents both employers and employees in a range of employment disputes. Lia also has experience in personal injury, public law, property and insolvency matters.

The breadth of her experience (and its focus on court work) means that she is an experienced advocate able to deliver an effective and comprehensive service to her clients which draws on her experience of multiple practice areas and of all stages of the dispute resolution process (from pre-issue and interim hearings, through to trial and enforcement).

In 2018, Lia undertook a six-month placement as a Judicial Assistant in the Commercial Court. She gained valuable experience of complex commercial trials, the full range of applications (e.g. jurisdictional disputes, freezing orders, search orders and disclosure) and an insight into the inner workings of the Court. Lia also has experience of appellate work, having undertaken a similar placement in the Court of Appeal before starting pupillage.

Before her placement at the Court of Appeal, Lia worked as a Research Assistant in the Commercial and Common Law team at the Law Commission. She also worked for three years at LawWorks, developing and managing a national pro bono advice project.

Expertise


Consumer Credit and Consumer Contract

Lia is regularly instructed to advise and represent clients in matters involving the provisions of the Consumer Credit Act 1974, Financial Services and Markets Act 2000 and the FCA Handbook. Her clients include most major UK lenders as well as smaller lenders. She occasionally acts for borrowers.

Lia advises on non-contentious regulatory issues as well as in the context of contentious litigation. She is regularly instructed to draft pleadings and applications (e.g. to strike out, or for summary judgment), attend case management hearings, allocation hearings, application hearings and to conduct trials in consumer credit matters.

She has experience of isolated claims and of groups of claims where multiple claimants are represented by the same firm of solicitors.

Having worked on various consumer projects during her time at the Law Commission, Lia began her practice with a detailed understanding of the Consumer Rights Act 2015 and the law on consumer protection more generally. She is now regularly instructed in a wide range of consumer claims brought against lenders under s.75 of the Consumer Credit Act 1974 as well as consumer contract disputes that do not involve a consumer credit element.

Lia’s work in the fields of consumer credit and consumer contract often raises issues relating to the General Data Protection Regulation 2016/679 (“GDPR”) and the Data Protection Act 2018 (“DPA”). Recently, she succeeded in defending a claim against a major UK lender for breach of the individual right of access under Art.15 of the GDPR. She is familiar with the provisions of the GDPR and the DPA and is able to assist clients with matters in which they are engaged.

Commercial

Lia has experience of a range of commercial disputes with a particular focus on cases arising out of contracts for the sale and hire of goods and for the provision of services.

Lia is also currently instructed on behalf of the Defendants in the Mercedes Benz NOx Emissions Litigation.

Lia has also assisted on large and complex insurance, finance and pharmaceutical matters.

 

Employment

Lia has been instructed in a range of employment matters in the ET, the EAT and in the civil courts. She acts on behalf of employers and employees.

Lia has considerable experience of advisory work, drafting and attending hearings (interim, final and appeal) in employment matters involving the following issues:

• Unfair/wrongful dismissal;
• Redundancy;
• Direct and indirect discrimination;
• Harassment;
• Victimisation;
• Reasonable adjustments;
• Equal pay;
• Unlawful deductions from wages;
• Working time;
• Restraint of trade;
• Professional discipline;
• TUPE; and
• Whistleblowing.

Lia gained considerable employment appellate experience during her time as a Judicial Assistant in the Court of Appeal.

Product Liability

Lia has experience in a range of claims arising out of defective products.

She is currently instructed as part of the counsel team for a major European car maker in the NOx emissions group litigation. She was also recently instructed as part of a team working on the UK claims that form part of a worldwide medical device group action.

She is also regularly instructed as sole counsel in isolated product liability claims. The breadth of her experience (e.g. in personal injury and general consumer matters) is highly valued by clients in this context.

Health and Safety, and Personal Injury

Lia has considerable experience working as sole counsel in employer’s liability claims, occupier’s liability claims and road traffic collision claims. She also has experience of health and safety prosecutions against employers, directors and individuals, as well as clinical and professional negligence actions arising out of personal injury litigation.

She is equally comfortable working as part of a team on larger cases. She was recently instructed to act as part of a team in an international mass tort claim which raised issues of jurisdiction, parent company liability in negligence and vicarious liability.

Lia also has experience of fatal accident claims under the Law Reform (Miscellaneous Provisions) Act 1934 and the Fatal Accidents Act 1976. She is regularly instructed to advise on quantum and to draft pleadings in such cases.

Administrative and Public Law

Lia has experience of judicial review challenges acting for both claimants and defendants. She is regularly instructed by local government in relation to funding, education and healthcare issues. She also has considerable experience of judicial review as a means of challenging the decision of an Ombudsman.

In addition, Lia has experience of public procurement, public inquiries and inquests.

Property

Lia has experience of residential and commercial landlord and tenant disputes, forfeiture proceedings, collective leasehold enfranchisement, leasehold extensions and a wide range of contractual disputes relating to property. She also has experience of nuisance, trespass and property-related professional negligence actions involving solicitors, surveyors and architects.

Insolvency

Lia has experience advising and representing clients in relation to bankruptcy, administration, liquidation and voluntary arrangements (individual and company).
