She has a particular interest in Chambers’ specialist area of product liability and group actions and has for many years been a junior on a key piece of medical products litigation alongside the leading product liability Silks in Chambers. Chloe also has a particular interest in public inquiries and the experience she can bring to those from group actions. Chloe acted as junior counsel to the Grenfell Tower Inquiry. Expertise
Product Liability, Personal Injury and Group Actions
Chloe has a particular interest in product liability and group actions and is recommended as a leading junior in product liability by Chambers UK and Legal 500 (2023). She has particular expertise in products claims involving group litigation or multiple claims subject to co-ordinated management. She has for many years been working as a junior, led by Malcolm Sheehan KC and James Purnell, on the UK claims that form part of a worldwide medical device product liability group litigation in relation to vaginal mesh. Chloe has a lot of experience in managing multiple claims and dealing with complex scientific and medical expert evidence. She has advised and acted on a wide range of product liability claims as well as advising on product recall and labelling requirements under UK and EU consumer protection laws and the complex chain of supply disputes that arise following a product recall, often involving cross jurisdictional issues.

Chloe represents the manufacturer of medical devices for the treatment of stress urinary incontinence and pelvic organ prolapse in the defence of claims brought by multiple claimants alleging defects/negligence in these coordinated High Court group claims.

LA & Others v Secretary of State for Defence (WP) [2014] UKUT 477 (AAC)
Chloe acted for the Ministry of Defence on the war pensions appeals brought by a group of Nuclear Test Veterans alleging exposure to ionising radiation as a consequence of British atomic tests carried out in the 1950s and 60s in the South Pacific and Australia, led by Leigh-Ann Mulcahy KC and Adam Heppinstall KC (see judgment here).
Public Inquiries, Health & Safety, Inquests
Chloe was instructed as junior counsel to the Inquiry on the Grenfell Tower Inquiry from its inception in 2017, led by Richard Millett KC, Kate Grange KC and Andrew Kinnier KC. She worked on the analysis of evidence for the Inquiry and the preparation of witness examination for the hearings. Chloe’s practice in Public Inquiry work is complemented well by her experience in group actions.
Chloe has had experience of a broad range of personal injury matters including claims for physical injury and psychiatric harm, occupiers’ and employers’ liability and RTAs, as well as being instructed in a personal injury group action for the MOD (see judgment here). She has also been involved in an inquest at the Coroner’s Court following a fatal accident at work encompassing health and safety issues.

Database Rights, Patents & Intellectual Property
Chloe appeared in the Supreme Court led by Patrick Green KC representing Professor Ian Shanks in his appeal from the Court of Appeal decision in Shanks v Unilever Plc & Ors [2017] EWCA Civ 2 in his claim for compensation under the Patents Act 1977 for his invention of a device used for blood glucose testing for diabetes. In a landmark decision handed down on 23 October 2019, Shanks v Unilever PLC & Others [2019] UKSC 45, the Supreme Court has awarded retired Professor Ian Shanks £2 million as a fair share of the “outstanding benefit” which Unilever received from his invention. This unanimous decision from the Supreme Court overturns the decisions of the IPO, the High Court and the Court of Appeal and fundamentally changes the established landscape in employee-inventor compensation cases under s.40 of the Patents Act 1977.

An employee patent compensation case, as to whether or not Unilever’s size is such that a benefit from patent licensing of more than £20 million is therefore not ‘an outstanding benefit’ entitling the inventor of the leading diabetic home testing technology to any compensation.

Commercial Disputes
Chloe has been involved in a range of commercial cases and has had experience of drafting pleadings and preparing written advice in claims involving breach of contract and interpretation of contractual construction as well as matters concerning misrepresentation, sale of goods and services, guarantees and indemnities and restitutionary claims for unjust enrichment. She is regularly instructed in business disputes in both an advisory and litigation capacity and applies her past business experience to advise on practical legal solutions. She is currently acting on an international business dispute which raises cross-border jurisdictional issues.
Employment
Chloe has a range of experience in employment matters. Most notably Chloe was instructed in a whistleblowing case led by Patrick Green KC brought by an NHS employee, successfully gaining permission to appeal from the Court of Appeal on behalf of the Claimant. She was also part of a legal team led by Patrick Green KC who assisted in the preparation of the Patients First Submission on the treatment of NHS employees when acting as whistleblowers in the interests of public safety, which was submitted to The Freedom To Speak Up Review conducted by Sir Robert Francis KC.
Company, Investment & Insurance Law
During her secondment as a Pegasus Scholar to Appleby in Bermuda, Chloe worked on high value shareholder disputes and a range of company and insurance law litigation in a leading offshore law firm. Upon return from Bermuda Chloe was instructed to work on an international investment fund dispute based in Bermuda. More recently Chloe has been led by Patrick Green KC on an investment fund dispute involving a claim against the promotors of a tax relief vehicle through which members invested in the production and distribution of films. Chloe has also assisted senior counsel in Chambers on insurance and reinsurance disputes, particularly in the context of product liability.
Finance & Consumer Credit
Chloe has gained a broad range of experience of finance and consumer credit law. She has assisted on matters involving the interpretation of the Consumer Credit Act 1974 and advised and acted on a number of loan agreement, credit and credit hire cases involving disputes over the application of section 75, the enforceability of agreements, disputes over default and termination notices, and unfair relationship claims. Chloe acted in a case which considered the effect of mis-sold Payment Protection Insurance on a claim for an assigned debt. Chloe has also been instructed on disputes over the coverage of insurance protection and chargeback facilities under credit agreements. Chloe has recently acted in high court proceedings involving the jurisdictional challenges faced when seeking to enforce foreign judgments on credit card debts accrued abroad.
For a number of years Chloe has been retained to work regularly for a leading international bank, advising and assisting the bank on the assessment of claims for consequential losses arising from the mis-selling of interest rate hedging products under the FCA Review. Working for the bank has given Chloe invaluable experience of the financial sector and a useful background from which to approach both financial litigation and regulatory work.
Property
Chloe has regularly been instructed on a range of property work, representing both private and public clients in contested possession actions and injunction applications. She has advised and drafted pleadings on claims involving the interpretation of easements, landlord and tenant disrepair and service charge disputes, enfranchisement applications, and the renewal of business tenancies under s. 25 of the Landlord and Tenant Act 1954. She has also acted in a number of trespass claims, most recently one which culminated in a successful committal application for contempt of court. Chloe also advises on cladding remediation costs in relation to the Building Safety Act 2022 and the Building Safety Fund and recently advised on the difficult issues faced in relation to leaseholder owned buildings under the current provisions.
