Charles Gibson KCGeraint Webb KC and James Purnell of Henderson Chambers have contributed to Clinical Negligence (Sixth Edition) published by Bloomsbury Publishing by updating their chapter on product liability

Their chapter addresses Product liability for medical products and focuses on the issue of civil liability for injuries caused, or allegedly caused, by medical products.  Their previous edition of the chapter was cited with approval by Hickinbottom J (as he then was) in Wilkes v Depuy [2018] QB 627.  The new edition has been expanded to include liability for medical devices as well as medicinal products.  The Chapter includes detailed analysis of the impact of Brexit, the regulatory context, claims under the Consumer Protection Act 1987, claims in negligence, claims in contract, causation, limitation and civil procedure (including in the context of group litigation).

The book as a whole remains the only text of its kind to cover both the medical and legal aspects of medical negligence. Written by a team of more than 60 experts, it continues to provide the most comprehensive and authoritative guidance on all aspects of clinical negligence claims, from bringing an action for damages to presenting expert evidence in court. It also includes detailed consideration of funding and cost implications.  The book is edited by Michael Powers KC and Anthony Barton. The chapters are by specialists from the bar, healthcare professionals and academia.
