Unless a Part 36 Offer made on the basis of periodic payments contained a provision whereby the Defendant Insurer might satisfy its liabilities to make such periodic payments by the purchase of an annuity and that the Claimant should submit himself to medical examination for that purpose, the Court would not impose those terms upon the Claimant.
