Arnold Ayoo appears in the Supreme Court

Arnold Ayoo appeared before the Supreme Court on 2 November 2022 in a case concerning the contract/unjust enrichment borderline.

Arnold (led by Brad Pomfret) appeared on behalf of the Respondent in Barton v Morris (in place of Gwyn-Jones). The parties had orally agreed fixed a fee (£1.2m) payable to an introducer if a property sold for a certain price (£6.5m). The property was sold, but for £6m – and the contract did not expressly set out whether a fee would be payable in that eventuality. The introducer claimed reasonable remuneration (in contract and/or unjust enrichment). The Supreme Court will decide whether the introducer is entitled to recover at all and if so, whether the claim lies in contract and/or unjust enrichment.
