Tim Green KC speaks at the International Law & Liberty Conference on cross-jurisdictional product litigation

Tim Green KC was invited to speak at the inaugural US/UK International Law and Liberty Conference held at the Law Society over 20 and 21 July. Tim joined a panel of product litigation experts with private and public sector experience chaired by a Judge Sutton, Chief Judge of the US Court of Appeals for the Sixth Circuit. The subject was “Mass Torts, Collective Litigation & the Evolving UK Claims Landscape”.

The panel explored how public nuisance theory might applied to regulated products; litigation funding economics after PACCAR (including foreign capital and transparency issues); expert witness independence; the developing UK consumer protection led by CMA and OPSS enforcement; and the Law Commission’s current reviews of product liability and the UK’s class action regime. The panel paid particular focus on practical comparisons between the UK’s opt-out collective actions framework, and the US MDL model.
