Isha Shakir appeared as sole counsel in the High Court before HHJ Marquand (sitting as a High Court Judge) in a civil penalties appeal.
Acting for the respondent, Isha successfully defended the appeal. She resisted a last-minute witness application and persuaded the Court to dismiss the appeal on all grounds, with costs awarded to her client.
The Court clarified that even short-term or trial-based engagement can constitute employment. It also reinforced the reach of vicarious liability, confirming that employer obligations cannot be avoided through absence or delegation.
