Benn Sheridan receives Highly Commended award for Bar Council law reform essay

Benn Sheridan has received a Highly Commended award in this year’s Bar Council law reform essay competition.

His essay ‘An opt-out class action regime for environmental claims’ examines procedural hurdles that claimants who suffer environmental harm face in seeking civil remedies.  It proposes a statutory solution: a class action regime, drawing on Competition law.

Benn says:

“I chose this topic because (a) I intend to develop a practice at the Bar in the group litigation and environmental law spheres, and (b) having considered ways in which these sectors might benefit from practical, expeditious reform, I concluded (after some time in the library) that the statutory competition regime might furnish Parliament with a template for an opt-out class action procedure to deal with mass environmental claims proportionately.”
