In an article for Lexis Nexis, Freya Foster considers the new regime for environmental review proceedings introduced in the Civil Procedure (Amendment No 2) Rules 2022.

The Environment Act 2021, which created the Office for Environmental Protection, granted that organisation the power to bring court proceedings in a new procedure called environmental review. Following a consultation that took place last year, amendments to the Civil Procedure Rules and the new Practice Direction 54E to accommodate environmental review proceedings have been published and will come into force on 1 October 2022. The new procedure closely mirrors the existing rules for judicial review claims.
