CAT litigation with nine lives: The rebirth of the class action?
This alerter by Noel Dilworth considers the decision of the Court of Appeal on 16 April 2019 in the MasterCard litigation (Walter Merricks v MasterCard Inc & ors [2019] EWCA 674), which allowed the Applicant’s appeal and remitted the application for a collective proceedings order (“CPO”) for reconsideration by the Competition Appeal Tribunal (CAT).
Subject to any appeal to the Supreme Court, this is a significant decision.
