Landmark victory in the Post Office Group Litigation
At noon today, Mr Justice Fraser handed down his high profile decision in the Post Office Group Litigation, Bates & others v Post Office Limited.
It is a watershed judgment in the developing area of relational contracts and considers a wide range of legal issues on incorporation of standard terms, unfair contract terms, and implied terms.
It represents a major victory for over 550 Claimants who have been represented throughout by Patrick Green QC, Kathleen Donnelly, Henry Warwick , Ognjen Miletic and Reanne MacKenzie of Henderson Chambers, instructed by Freeths LLP.
As well as deciding very important legal points, Mr Justice Fraser made clear findings about how the Post Office had treated the six individual Lead Claimants who gave evidence in the November / December 2018 trial and its wider approach to pursuing supposed debts shown on the Horizon computer system.
