The Court of Appeal (Jackson, Rafferty and Kitchen LJJ) has upheld the judgment of Simon J holding that there is no right of appeal against the decision of an Official Veterinarian (OV) to refuse to place a Health Mark on a carcase in a slaughterhouse. The Judicial Review was brought by the Association of Independent Meat Suppliers in an effort to establish such a right of appeal in EU and human rights law. They have sought permission to appeal to the Supreme Court.
