Court of Appeal Judgment

The Court of Appeal (Jackson, Rafferty and Kitchen LJJ) has upheld the judgment of Simon J holding that there is no right of appeal against the decision of an Official Veterinarian (OV) to refuse to place a Health Mark on a carcase in a slaughterhouse. The Judicial Review was brought by the Association of Independent Meat Suppliers in an effort to establish such a right of appeal in EU and human rights law. They have sought permission to appeal to the Supreme Court.

The judgment is here and an earlier alerter, by Hannah Curtain, on the first instance decision is here.

Sir Alan Dashwood QC and Adam Heppinstall represented the Food Standards Agency.
