Brexit Article 50 Judicial Review: hearing before the Lord Chief Justice this week

Patrick Green QC, Henry Warwick and Matthieu Gregoire are appearing in the much publicised Judicial Review concerning the Government’s proposal to give notice to leave the EU under Article 50 Treaty of Lisbon without the further consent of Parliament, which is to be heard by the Lord Chief Justice on Thursday 13 October 2016.

Their clients, known as the ‘Expat Interveners’ in the case, are a group of British citizens who are all Members of Fair Deal for Expats, an organisation set up since the referendum in order to try to achieve the best deal for the estimated 1-2 million British Citizens who live in another EU country. Each of them lives in, or has significant connections with, another EU member state and are profoundly affected by the issues arising in these proceedings.

Fair Deal for Expats is crowd-funding their involvement in the case, as well as a further challenge in the General Court of the European Union to annul the order of President of the Commission, Jean-Claude Juncker, banning negotiations between the UK and the European Commission until notice is given under Article 50.

In accordance with a recent order of the Court permitting the publication of the parties written arguments, Fair Deal for Expats are publishing their Skeleton Argument and Clarificatory Note:

The Skeleton Argument is here.

The Clarificatory note is here.

Patrick, Henry, Paul and Matthieu are instructed by Croft Solicitors.
