A team from Henderson Chambers (which has included Charles Gibson QC, Geraint Webb QC, Toby Riley-Smith, Adam Heppinstall, Nazeer Chowdhury, Abigail Cohen, Paul Skinner and Ognjen Miletic), instructed by Hogan Lovells International LLP, acted for Shell’s Nigerian subsidiary, SPDC, in the Bomu-Bonny Oil Pipeline Litigation which, it was announced today, has been the subject of a settlement.
In one of the largest international environmental group actions of its kind, around 15,000 individual claimants as well as representative claimants acting on behalf of the whole Bodo Community sought damages arising out of two operational oil spills which occurred in 2008 in the Niger Delta from a pipeline operated by SPDC. The litigation was managed by Akenhead J in the TCC who delivered a preliminary issues judgment in the proceedings in June 2014.
The matter had been set down for trial of an unprecedented number of up to 50 lead cases, and involving up to 14 expert witnesses, commencing May 2015.
