TUPE and Pre-Pack Administration at EAT

The Employment Appeal Tribunal has today ruled that buyers of pre-pack companies in administration are liable for unfair dismissal compensation payments where the employee was dismissed after the transfer of the buiness.  The transferee-buyer in this case had argued that the Secretary of State should be liable for the payment.  Adam Heppinstall represented the Secretary of State.  The judgment is here - Pressure Coolers v S/S BIS.
