Nuclear Test Veterans in Supreme Court Appeal
Charles Gibson QC, instructed by the Treasury Solicitor on behalf of the Ministry of Defence, appeared in the Supreme Court in the Nuclear Test Veterans Litigation for 3.5 days, from 14th to 17th November 2011. The Court considered the questions of statutory knowledge and causation in the context of the Limitation Act 1980.
Having successfully argued in the Court of Appeal that 9 out of 10 lead claims of the group action brought in the wake of Britain's nuclear tests in the 1950s ought to be dismissed on grounds of limitation, the appeal has now progressed to the Supreme Court.
Judgment is expected in the New Year.
