Nuclear Test Veterans in Supreme Court Appeal

Charles Gibson QC, instructed by the Treasury Solicitor on behalf of the Ministry of Defence, has been instructed to appear in the Supreme Court in the Nuclear Test Veterans Litigation.  Having successfully argued in the Court of Appeal that 9 out of 10 lead claims of the group action brought in the wake of Britain's nuclear tests in the 1950s ought to be dismissed on grounds of limitation, the appeal has now progressed to the Supreme Court.

On 28 July 2011 the Justices considered the application for permission to appeal and have set down an expedited hearing for 3 1/ days starting on 18 November 2011, when the Court will consider the application of statutory knowledge and causation to section 33 of the Limitation Act 1980.
