Henry Warwick was called to the Bar in 2007 and practices in commercial law, with particular experience in finance and consumer credit law, product liability and professional negligence.
Prior to joining the Bar, Henry practiced in the Litigation and Arbitration Group at Linklaters, having qualified as a solicitor in 2000. Following a post graduate LLM at Cambridge, Henry worked as Legal Counsel for the Permanent Court of Arbitration in The Hague.
Henry draws upon a background representing clients in banking and finance, professional negligence and commercial disputes and in both domestic and international arbitrations.
Finance and Consumer Credit
Henry has a specialist practice in finance and consumer credit law. He is instructed in proceedings concerning a variety of credit agreements including asset finance, personal loan and credit card agreements and associated PPI policies. He advises on a full spectrum of related issues, ranging from incorporation of terms and execution, to unfair terms, assignment and novation as well as allegations relating to breach of fiduciary duty and unfair relationships.
Henry is also instructed in disputes concerning financial regulation, including claims for damages arising from regulatory breaches. His recent instructions include acting as Junior Counsel in a high value claim relating to the provision of on-line share dealing and share custody facilities.
His recent instructions have included:
- Acting in series of claims arising out of the fraudulent activities of vehicle finance brokers.
- Representing lenders in claims relating to the sale of payment protection insurance.
- Representing a lender in complex proceedings concerning the scope and application of the law relating to protected goods.
- Appeal concerning the validity of assignments of consumer debts.
- Routine appearances in claims for the enforcement of credit agreements giving rise to a full range of contractual and statutory defences and counterclaims.
Product Liability
Henry represents and advises clients in complex litigation concerning product defects. He is instructed to advise clients on the full range of associated issues, including matters of private international law, complex limitation issues, contribution claims and subrogated insurance claims. Henry’s recent instructions include:
- Junior counsel (led by Geraint Webb) in proceedings brought by a major UK retailer against an overseas manufacturer relating to defective electrical goods giving rise to a series of property damage and personal injury claims. Advising as sole counsel in a range of underlying consumer claims.
- Acting for and advising lead defendants in high value group litigation brought by 435 claimants against a range of financial institutions and dealers in relation to alleged defects in commercial vehicles.
Commercial
Henry represents clients in a wide variety of commercial disputes including in construction, sale of goods and supply of services and investment disputes. His recent instructions have included:
- Junior counsel in an investment dispute relating to the EU-wide launch of patent-protected water sanitation technology.
- Representing commercial property investor in High Court proceedings for the recovery of sums due pursuant to a series of joint venture agreements.
- Obtaining interim prohibitory injunctions in support of noise and waste water nuisance claims.
- Junior counsel in proceedings relating to the issue of performance bonds in relation to construction projects.
- Claim for damages arising from delays and/or defects in the performance of construction contracts.
Professional Negligence and Discipline
Henry has acted for and against a variety of professionals including financial advisers, solicitors, accountants, estate agents and veterinary surgeons. His instructions have included:
- Appearing on behalf of the Investigation Committee in Institute of Chartered Accountants (ICAEW) disciplinary proceedings.
- Acting for veterinary surgeons in claims concerning clinical procedures.
- Acting both for and against solicitors in claims relating to alleged negligent conduct of litigation.
- Valse Holdings SA v. Merrill Lynch [2004] EWHC 2471 (Comm): Representing bank in Commercial Court claim regarding the duty to warn of financial risks (as a solicitor).
Employment
Henry is routinely instructed to appear in Employment Tribunals by both Claimants and Respondents in a variety of claims. His recent cases include:
- Junior counsel in a high value claim for unfair dismissal following ‘whistle blowing’ by a former employee of a hedge fund.
- Representing the lead Claimant in a series of claims against a government agency for unlawful deduction from wages.
Arbitration
Henry draws on experience in both domestic and international arbitrations, conducted ad hoc and pursuant to a range of institutional rules. He acted as tribunal secretary and provided background support to international arbitral tribunals as Legal Counsel at the Permanent Court of Arbitration in The Hague.
- Commercial arbitration (1996 Act) in London between franchise operators in training and business referral sector.
- Arbitration in Portugal (UNCITRAL Rules) of a claim by UK investor against an African state for expropriation of assets in the mining sector (as solicitor).
- Arbitration between main contractor and sub-contractors concerning the construction of a Ministry of Defence procurement facility (as solicitor).
- Support on substantive and procedural issues to tribunals in disputes concerning rights and obligations in public international law including Guyana v. Suriname, PCA (2007), Eurotunnel Arbitration, PCA (2007) and a range of disputes between investors and states pursuant to bilateral and multilateral investment treaties (as PCA Legal Counsel).
Property and Landlord and Tenant
Henry is instructed by local authorities, housing associations and private landlords in a variety of housing disputes. He acts for landlords and tenants in service charge disputes and valuation disputes before the Leasehold Valuation Tribunal and advises commercial clients on matters of landlord and tenant law.
