Angus has a common law and commercial practice with particular expertise in personal injury, health and safety, product liability, regulatory proceedings and employment law.

Personal Injury

Angus has a strong personal injury practice, which covers the full range of accidents.  He is particularly noted for his work relating to catastrophic work place accidents and in cases where there are difficult issues of medical causation and allegations of fraud.

He is recognised as a leading personal injury practitioner by the Legal 500.

  • Grant Couzens v T McGee and Co Ltd (now T/A T McGee Group Ltd) (2009)
    A piece of scrap metal that a lorry driver had used as a makeshift work tool in the course of his duties did not amount to "work equipment" under the Provision and Use of Work Equipment Regulations 1998 reg.3(2) because his employer had no knowledge of the scrap metal, and therefore did not expressly or impliedly give permission to use it: (2009) PIQR P14
  • Peries v Thames Water Utilities Ltd (2007)
    Utility company held not liable for breach of duty of care so as to pay damages for personal injuries for an access cover situated on private land, which presented a danger as a result of the erosion of the ground surrounding it.

 

Health and Safety

Angus has considerable Health & Safety experience appearing in the Divisional, Crown and Magistrates Courts, notably in the defence of prosecutions instituted by the HSE.  He has also acted in a number of prosecutions brought by the London Fire and Emergency Planning Authority alleging contravention of the Regulatory Reform Order.

Product Liability

Angus is regularly instructed in relation to product liability claims and has particular experience in relation to product recall and the obligations imposed by the General Product Safety Regulations.

  • Smith's Vitamins & Herbs Ltd v Ceprodi Compagnie European De Produits Dietetiques SA - [2010] All ER (D) 196 (Mar).  Contractual claim arising from supply of food supplements in France. 

Commercial and Insurance

Angus undertakes general commercial and contractual litigation, particularly in relation to insurance, guarantees and the sale of goods.

Employment

Angus undertakes a full range of employment work, including all aspects of discrimination. He regularly appears in the EAT, Tribunals and the civil courts in relation to such claims.

  • Vivian v Bournemouth Borough Council (2011) EAT;  whether protected disclosures could be said to have resulted in the unfair dismissal of an employee
  • Whitelock and Storr v Khan (2010) EAT; successful appeal of a Tribunal’s finding that a solicitor had been dismissed for making a protected disclosure
  • G v T Bank (2010): successful claim of age discrimination on behalf of a trader employed by a international bank
  • Hancock v East Sussex County Council - [2003] All ER (D) 423 (Dec); requirement of an Employment Tribunal to apply expert evidence to the question as to whether a teacher was disabled

Property

He also often regularly acts in respect of claims in which the acquisition of rights to land are sought.  Angus is also experienced in other property-related disputes, including those concerning boundaries and the enforcement of mortgages.

Professional Discipline

Angus has acted as a Legal Assessor for the General Osteopathic Council and the Chartered Institute of Management Accountants.  He has also represented clients in relation to proceedings before the Institute of Chartered Accountants, the Institute of Structural Engineers and the Architects Registration Board.
