Adam retains a broad practice advising and representing individuals, companies, charities and a full range of public sector bodies across a wide range of practice areas. The Legal 500 describes him as "calm, measured and extremely competent" and Chambers UK as "tactically astute" and "the 'very bright' Adam Heppinstall who provides 'clear, sensible advice' and brings a spirited approach to his cases". He is junior counsel to the MOD in the Nuclear Test Veterans Group Action which was recently the subject of a leading judgment of the Supreme Court in the areas of personal injury, limitation, causation and group actions and the judgment can be found here.
Group Actions
Adam is currently junior counsel for the MOD in the Nuclear Test Veterans Group Action in which judgment for the MOD was recently handed down by the Supreme Court (see here), having already been heard by the High Court and Court of Appeal. Previously he was also junior counsel as part of a large team instructed to advise Cape in the South African Asbestos Mining Group Action.
Public Sector
Adam is Junior Counsel to the Crown (Panel B) and in that capacity advises a wide range of government bodies and agencies in relation to many different practice areas. He is currently engaged to represent the MOD in 15 war pensions’ appeals arising out of the Nuclear Tests in the 1950s. He has substantial public law experience, recently appearing in a judicial review against the Secretary of State, for a charity (R(ESB) v Home Secretary [2011] EWHC 1788 (Admin)). He is currently instructed in control order proceedings for the Secretary of State. He has public procurement expertise and has acted for both companies challenging awards and public bodies defending them. He has public inquiry experience, having appeared before the Shipman Inquiry. He has advised many local authorities on a wide range of issues relating to their powers, procedures and policies.
Employment
Adam has wide experience of employment law. He appeared for the local authority in Prater -v- Cornwall County Council and more recently for the Secretary of State in Pressure Coolers v Secretary of State. He has particularly experience of claims in the public sector, particularly education. TUPE, employment status, insolvency, minimum wage are particularly niche areas of expertise as well as discrimination, redundancy and unfair dismissal. He also deals with restrictive covenants, protection of copyright, pension appeals and other employment related issues. He has represented several financial institutions, especially in cases concerning the interaction between FSA regulation and employment law. He is the co-author of “Manual of Employment Appeals” Jordans, 2008.
Regulatory and Disciplinary Law
Adam has long experience working in the healthcare sector. He represented the GMC before the The Shipman Inquiry and in the case of Professor Sir Roy Meadow -v- General Medical Council. He has represented a range of health professionals before Coroners and internal inquiries/investigations. He has also acted for professionals such as nurses, osteopaths and in the psychotherapy profession. Outside of healthcare he acts for accountants, solicitors and vets before their professional bodies. He is cited by Chambers UK and Legal 500 in this area of law.
Property and Environment
He acts for numerous commercial and residential landlords in respect of a range of issues including tenant insolvency, lease renewal, service charges, disrepair and anti-social behaviour proceedings.
He has represented a range of large property owning bodies including a major rail infrastructure company, the Environment Agency, Transport for London and the MOD. He also acts for householders, farmers and tenants. He has particular expertise dealing with rights of way, freehold covenants, conveyancing mistakes, land drainage, statutory nuisance, flood defence, service charges and other property and environmental law matters. He also acts for cohabitees in TLATA cases. He has appeared before the LR Adjudicator, LVT, RAC and the RPT.
He has advised several local authorities in respect of their housing policies, regeneration projects, public procurement exercises, bids for central government grants and FOI/DPA procedures. He has particular expertise in respect of the Housing Act 2004, including the tenancy deposit scheme, housing standards and houses in multiple occupation.
He has acted for and advised the Residential Property Tribunal Service and the London Development Agency relating to compulsory purchase issues arising out of the London Olympics 2012.
He is recommended by the Legal 500 in this area of law.
Health and Safety and Personal Injury
Adam has advised several companies in criminal prosecutions and civil claims arising out of health and safety related matters. He has particular expertise in asbestos personal injury claims (Simon -v- Secretary of State for Communities and Local Government and another [2008] All ER (D) 89 (Feb)) as well as those arising in the public sector (police, prison, fire and waterways). He has spent many years being instructed by insurers and their solicitors; working on road traffic, employer’s liability and public liability claims. He has appeared for several companies and individuals (and families of victims) before Coroners where health and safety issues have been raised.
Commercial
He also has wide experience of all types of commercial disputes. He has advised on franchise agreements, finance leasing arrangements, agency agreements and all forms of consumer credit. He has represented companies in health and safety and local government regulatory prosecutions. He has acted in construction adjudications and Institution of Civil Engineering Arbitrations as well as in other forms of arbitration and mediation, including property, employment and commercial Din Torahs before the London Beth Din. He has been seconded to the legal departments of the Financial Services Authority, Railtrack and Nestlé (UK) Ltd.
